TERMS AND CONDITIONS
EFFECTIVE DATE: 01 January 2024
GENERAL
Welcome to ByCloudHaus. These standard Terms and Conditions, govern your purchase of products and services from ByCloudHaus. By placing an order with us, you agree to these terms.
ORDERS, QUOTATIONS AND PAYMENTS
Quotations: Quotations provided to the Customer by ByCloudHaus, will be capable of acceptance within a period of 7 (seven) days from the date stated upon the document, thereafter, ByCloudHaus reserves the right to alter or withdraw said quotation.
Order Finalisation: All orders are final upon submission. Once you confirm your order and payment is processed - no modifications, cancellations, or refunds will be allowed. This policy is in place due to the customised nature of our furniture and the upfront costs involved in procuring materials and compensating our staff.
Payment: 70% or Full Payment is required at the time of order. Orders will not be processed until agreed upon payment is received. In the case of the 70% deposit agreement, the order will only be delivered upon receiving the balance (30%).
ByCloudHaus does not accept cheque payments due to the high risk of fraud.
If the Customer fails to make any payment by the due date, all discounts of whatsoever nature will be forfeited.
LEAD TIME
All our products are custom-made and require a production period of approximately 3 to 4 weeks from the date of order confirmation. Please note that in the event of manufacturing errors or unforeseen issues, we reserve the right to extend the lead time based on the unique nature of each order and the necessary adjustments to the manufacturing process.
DELIVERY
The Customer is responsible for all costs related to the delivery of the Product/s. ByCloudHaus will include Delivery costs within the quotation.
While ByCloudHaus endeavours to organise country wide delivery, delivery to all locations cannot be guaranteed.
Risk in and to the Product/s pass onto the Customer upon delivery.
NO RETURNS AND REFUNDS
No Refunds: Due to the nature of custom-designed furniture by ByCloudHaus, all sales are final. No refunds or exchanges will be provided.
Defects and Warranty: All Product/s are inspected before Delivery using quality control measures, however, if you discover any manufacturing defects, please contact us within 7 (seven) days. Normal wear and tear, misuse, and damage caused by improper care are not covered under this policy.
LIMITATION OF LIABILITY
ByCloudHaus is not liable for any indirect, incidental, or consequential damages resulting from the use of our products. Our maximum liability for any claim regarding manufacturing defects arising from your order is limited to the amount paid for the product and must be provided to us within 7 (seven) days of delivery.
MATERIAL VARIATIONS
Natural Materials: Many of our products use natural materials, which may result in variations in color, texture, and grain. These variations are not considered defects but are part of the uniqueness of each piece.
The colour, texture and composition of fabric or wood vary from products displayed instore and on the website. Due to many variations in monitors or browsers, colour samples may appear different as in store.
CUSTOMER RESPONSIBILITIES
Product Care: You are responsible for proper care and maintenance of your furniture. Please refer to the ByCloudHaus Maintenance Guide for instructions on maintaining the quality and longevity of your product.
Intellectual Property
All designs, images, and materials provided by ByCloudHaus are the exclusive property of the Company. Any reproduction or distribution without prior written consent is prohibited.
GOVERNING LAW
This Agreement is governed by the laws of South Africa. Any disputes arising under this Agreement shall be resolved in the competent courts of the Magistrates Court.
AMENDMENTS
ByCloudHaus reserves the right to update these Terms and Conditions at any time. The updated version will be effective as of the date listed above.
